ALERT: Texas Judge: State Cannot Arrest Democratic Lawmakers who Fled to Washington, DC

Texas District Judge Brad Urrutia (D) on Sunday issued a restraining order that prevents state police from obeying Governor Greg Abbott’s (R) call to arrest Democratic lawmakers returning from a field trip to Washington, DC.

The order also blocks a civil warrant for Texas State Rep. Philip Cortez (D) signed by Texas House Speaker Dade Phelan (R).

“The speaker thinks he can wave his hand and have his political opponents rounded up and arrested,” argues Texas State Rep. Jasmine Crockett (D). “We’re watching a major political party backslide in real time from fair representation, the rule of law, and democracy itself.”

Crockett is among more than 50 Texas House Democrats who traveled to DC in July to support an election measure in Congress. With the lawmakers absent, the chamber lacked the quorum necessary to hold a vote on election reform in Texas during a special session called by Governor Abbott.

“The ruling by the Travis County judge is contrary to the Texas Constitution and violates the separation of powers between the different branches of government,” argues Renae Eze, a spokesperson for Governor Abbott. “We are confident that this overstep will be overturned. Texas Democrats need to stop the charades and get back to work.”

The restraining order is set to last for two weeks and Urrutia will hear arguments on a temporary injunction later this month.

“No matter what the governor or speaker have said, it is a fundamental principle in this country that no one has the power to arrest their political opponents,” argues attorney Samuel E. Bassett. “That is why this action had to be filed.”

Republicans will argue that Democrats abandoned their sworn duties as lawmakers by leaving the state legislature during a special session and are thus at the mercy of law enforcement.

Governor Abbott has promised to continue calling for special sessions until the Democrats abandon their childish behavior.

    1. I with you on this. The only thing a Democrat can do better than anyone is hide. They were elected to pass and not pass bills, not by running and hiding but by working together. If this was a business and someone don’t show up for work for a couple of weeks, you terminate them.

  2. This article is a little late since the Texas Supreme Court has already ruled it is OK to arrest them. The rule of law requires it since it is in the Constitution a fact the lower court judge totally overlooked.

Isn’t odd , that a Hawaii judge could LIMIT what sitting U.S. President could do , and get away with it , yet a democrat judge says nothing can be done to unlawful flight of democrats to Washington is okay? Am I missing something , or is a certain Dem. judge is unwilling to uphold the Law , unless it fits HIS NARRATIVE ?

    1. We can only hope the Texas Supreme court slaps this fool down hard and makes a public display of it.
